BUCKS COUNTY IMPLEMENTS COUNTYWIDE DNA COLLECTION

The Bucks County District Attorney’s Office recently announced that it would begin to request a DNA sample from anyone arrested. A private laboratory will then analyze and catalog those DNA profiles, comparing DNA profiles collected to unknown samples collected at crime scenes.

REASONABLE SUSPICION NEEDED TO EXTEND TRAFFIC STOP FOR CAR SEARCH

Police need specific facts giving reasonable suspicion to extend a traffic stop after issuing a citation when extending the stop to search for evidence of a crime. Without those factors present, any consent to search could become the product of an illegal detention.

POLICE CANNOT EXTEND TRAFFIC STOP TO PERFORM CANINE SEARCH

When conducting a traffic stop of a car, police cannot extend that traffic stop – either before or after issuing a citation – to perform a canine search for drugs or other illegal substances without probable cause or reasonable suspicion.

LIFETIME REGISTRATION FOR JUVENILES AS SEX OFFENDERS UNCONSTITUTIONAL

The Pennsylvania Supreme Court recently ruled that a requirement for juveniles to register as lifetime sex offenders is unconstitutional. The Court found that the statute painted with too broad a brush and ignored research which found low levels of recidivism among adolescents committing these offenses.

PROBLEMS IN EYEWITNESS IDENTIFICATION

In court, few things are more damaging to the accused than an in-court, eyewitness identification. Although high, courtroom drama, the eyewitness identification is prone to human error. In Pennsylvania, the accused now can present expert testimony to explain these pitfalls and the science behind eyewitness identifications.

SCHOOL ZONE DRUG MANDATORY MINIMUM SENTENCES UNCONSTITUTIONAL

The Superior Court recently ruled that mandatory minimum sentences for drug trafficking in school zones are unconstitutional as applied in PA.

TRAFFIC CHECKPOINT MUST COMPLY WITH DUI CHECKPOINT RULES

The Superior Court ruled that police must follow the same protocol in establishing a traffic safety checkpoint as they would in a DUI checkpoint.
